You should read these carefully as this is a binding agreement with yourself and WeSwapBooks. By using the website you are fully accepting the terms, conditions and disclaimers in this notice. 2.  GENERAL RULES & GUIDELINES

2.1  When you use www.weswapbooks.com you can not:

• Add books to inappropriate sections of the site.
• Add books that are not your own property without the express permission of the owner.
• Fail to deliver ‘swapped books’ that you have confirmed that you wish to swap.
• Give false information on the book that you add to the website; or add counterfeit items or breach any laws.
• Use the website to distribute or post spam, messages or viruses.
• Use, copy or modify the logo or content from the website without permission from WeSwapBooks.
• We will do our best to restrict any offensive material or problems effecting the website. If you view anything you feel is in breech then please report to us.
• If you think another user maybe in breach of the terms of use then you should report them to WeSwapBooks

2.2  We Swap Books is a website that allows registered users to add/display books that they would like to swap for other books added/displayed on the website. Our service allows users to exchange postal address to allow delivery of swapped books.

2.3  We trust our users to add legal, safe items with accurate descriptions and information. We can not guarantee this and can not be held responsible for

• The quality of the books
• The safety of the item
• The legality of the displayed item
• The truth or accuracy of the descriptions/information given by the user
• The ability of the registered user to supply the listed item
• The method in which swapped items are delivered before and after the transit, therefore do not assume that all is valid and legal when displayed on WeSwapBooks as we do not check all listings.

2.4  We Swap Books does not review listings provided by users and we are not involved in transactions between members. We have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of users to provide books, or the legitimacy of any users supplying or obtaining books.

2.5  WeSwapBooks is solely for the exchange of books and printed reading material. Do not try to swap other items on the website.

2.6  WeSwapBooks is a family suitable website therefore there are certain materials that cannot be listed with us

• Pornographic material
• Unlawful material
• Racist material or likely to incite hatred
• Threatening material
• Obscene material
• Illegal material
• Images of criminal acts

WeSwapBooks does not accept any obligation to protect you from the above items, or any other items considered to be offensive or harmful.

2.7  We can remove, at the administrators discretion at any time, a book that has been added to www.weswapbooks.com. We may do so without notice and without offering a reason for withdrawal.

2.8  We can not be responsible if a swap transaction does not complete.

2.9  If you have a problem with another user and you believe they are in breech of www.weswapbooks.com we will investigate to the best of our ability, however we will not get involved in disagreements and/or disputes.

2.10  The content of the Website does not constitute advice and should not be relied upon in making or refraining from making any decision.

2.11  Once a swap has been completed the book owner should not expect the book they swapped returned to them. A member should understand that books they add to the website, if involved in a swap, will not be returned.

3.  THE SWAPPING PROCESS

3.1  By agreeing to swap books with another user you are entering into an agreement with that user that you will post their selected book to their address within two days of the swap being agreed by both parties. If you are initiating a swap you are agreeing that your book list is up-to-date and that you have the ability to post any one of the books on this list within two days of the swap being agreed by the other user. If another user has initiated the swap and you are accepting it then you are agreeing to post the user’s selected book to them within two days.

3.2  By agreeing to swap books with another user you are also agreeing that we will give your postal address, and possibly your email address to the user whom you have agreed to swap with. We take no responsibility for any misuse of this information.

3.3  Before agreeing to swap books with another user you must ensure that you would legally be able to sell any books that you are providing, and would legally be able to buy any books that you are obtaining, within the United Kingdom.

5.2  You are solely responsible for every action that is done on or through weswapbooks.com while your membership account is logged on. Although we will never purposefully disclose any of your membership account details to another person, except for those necessary to carry out the swapping process, we are not responsible for the interception or disclosure of your account details at any time. We advise you that you take the appropriate action to keep your login and password secure at all times.

5.3  You must not transmit through weswapbooks.com any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise breach any applicable law or regulation. You must not attempt to gain unauthorised access to our computer system or the computer systems of any other member.

5.4  Your email address is required in order to register. Your email address will help us to verify your identity. In the event that you register using a non-existent email address or an email address that belongs to someone else, weswapbooks.com may terminate your account without notice. The details that you provide for registration should be current. If you change details advise us at admin@weswapbooks.com. We can terminate/suspend your account if it is not found to be current, valid or your own email account.

5.5  You must be 18 years of age or over to become a user of weswapbooks.com. Under the age of 18 a parent or guardian should be supervising and be the registered user of the website. They are then the responsible person to adhere to terms and conditions.

5.6  The site allows members to leave ratings on other members (between 1 and 5) based on their experience of swapping with other members. You acknowledge and accept that ratings relating to you will be available for viewing by anybody using the Website. We do not view ratings and feedback, and are not responsible for checking or editing the ratings or feedback on the Site. You consent to the publication of ratings even though these may be critical or defamatory. You release weswapbooks.com and its employees and agents from, and waive all rights against weswapbooks.com and its employees and agents in relation to any liability in relation to the publication of defamatory comments in ratings and feedback, even though we may be aware of such comments.

5.7  When submitting ratings for another member you must comply with the Feedback Guidelines. You agree to indemnify and hold weswapbooks.com and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to ratings and feedback left by you on the Website.

5.8  Our service allows users to exchange postal addresses to allow delivery of swapped books. You are asked to respect the privacy of the user at all times, and their security and only use this information for the purpose of which it was supplied. This information is given by users to allow delivery of the exchanged item only, and to form an agreement of completion of swap transaction. You must not send any offensive, inappropriate or other material than agreed. weswapbooks.com has no control in this matter. All users must not use inappropriate language, anything that could be considered vulgar, distasteful language, abusive, unlawful, threatening, defamatory or offensive is not acceptable.

5.9  If you fail to send a book as agreed during the swapping process or send offensive or inappropriate content to any weswapbooks.com user or post or send offensive or inappropriate content anywhere on or to weswapbooks.com (including the Community) or otherwise engage in any disruptive behaviour on weswapbooks.com, and weswapbooks.com considers such behaviour to be serious and/or repeated, weswapbooks.com may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school or email provider about the infringement/s.

5.10  The messaging system has been added to the site to allow members to contact other members. Any abuse of this system will result in the abuser begin banned from the site. Continued abuse and weswapbooks.com considers such behaviour to be serious and/or repeated, weswapbooks.com may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school or email provider about the infringement/s.

6.  COPYRIGHT

6.1  All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics, and all software and source codes connected with the Website) are owned by or licensed to weswapbooks.com or otherwise used by weswapbooks.com as permitted by law.

6.2  In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without prior consent of the copyright holder. 8.5  We Swap Books does not cater for the purchase of books, but strictly speaking it is possible to buy and sell books using We Swap Books (find out more here). If the site is used in this way, We Swap Books is not responsible for any books that go missing or cash not recieved in return for a book. We are also not liable to replace either missing books and/or missing cash.

9.  INDEMNITY

You agree to indemnify and hold weswapbooks.com and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against weswapbooks.com arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

10.  SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

• Users of all ages and abilities may be taking part in the Forum so please be patient.
